These Terms of Service ("Terms") are a legal agreement between you and Desert Sky Builders LLC ("Company," "we," "us"), governing your use of Keel — the website, mobile apps, and email-forwarding service (together, the "Service"). By using Keel, you agree to these Terms. If you do not agree, do not use the Service.
Keel analyzes content you submit — text, email, photos, or voicemail audio — using artificial intelligence and, where applicable, third-party security databases, and returns a risk assessment ("verdict") to help you decide what to do next.
Keel is advisory only. It is not:
AI systems make mistakes. Keel may fail to flag an actual scam, or may flag something that turns out to be legitimate. You are solely responsible for every decision you make, whether or not it follows Keel's verdict. If you believe you have been targeted by fraud, contact local law enforcement or report it at reportfraud.ftc.gov.
You must be at least 13 years old to use Keel. If you are under 18, you may use Keel only with the involvement of a parent or guardian. Keel is built with older adults in mind, but it is controlled entirely by the person using it — Keel never shares your information with family members, caregivers, or anyone else without your own action.
Keel does not require you to create an account or password. You are responsible for:
You agree not to use Keel to harass, impersonate, or investigate other people without their knowledge or consent, or to submit content that is unlawful, abusive, or violates someone else's rights.
Keel relies on outside services to function, including Anthropic's Claude AI (analysis), Mailgun (email forwarding), VirusTotal (link/sender reputation checks), and OpenAI's Whisper (voicemail transcription), as well as the Apple App Store and Google Play for mobile distribution and billing. We do not control these services and are not responsible for their outages, errors, delays, policy changes, or any inaccuracy they introduce into a Keel verdict. If an upstream service is unavailable, parts of Keel may be slow, degraded, or temporarily unavailable.
The Keel web tool is free to use. The mobile app may be offered as a paid download or subscription through the Apple App Store or Google Play. All billing, trials, renewals, and refunds for mobile purchases are handled by Apple or Google under their own terms — not by us directly. Contact Apple or Google support for billing issues, or refer to their refund policies.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY VERDICT WILL CORRECTLY IDENTIFY A SCAM OR A LEGITIMATE MESSAGE.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW: (A) DESERT SKY BUILDERS LLC, ITS OWNERS, AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF MONEY, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES; AND (B) OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (I) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (II) $100.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
You agree to defend, indemnify, and hold harmless Desert Sky Builders LLC and its owners from any claim, loss, or expense (including reasonable attorneys' fees) arising from your misuse of the Service or violation of these Terms.
Keel, its design, verdict methodology, and all related materials are the property of Desert Sky Builders LLC. You retain ownership of any content you submit for analysis; you grant us a limited license to process it solely to provide you a verdict, per our Privacy Policy.
You may stop using Keel at any time. We may suspend or terminate access for anyone who violates these Terms or misuses the Service. Because Keel does not require an account, "termination" generally means we stop accepting submissions from you (for example, blocking a forwarding address used for abuse).
Please read this section carefully — it affects your legal rights.
Any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration under the rules of the American Arbitration Association, rather than in court, except that either party may bring an individual claim in small claims court. You and we each waive any right to a jury trial and to participate in a class action.
30-day opt-out: You may opt out of this arbitration clause by emailing keel@desertskyaz.com with your name and a clear statement that you opt out, within 30 days of first using the Service. If you opt out, disputes will be resolved in the state or federal courts located in Yavapai County, Arizona, and you keep your right to a jury trial and to participate in a class action.
These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles, except where Section 11 directs disputes to arbitration.
We may update these Terms from time to time. If we make a material change, we will update the "Last updated" date above. Continued use of Keel after a change constitutes acceptance of the updated Terms.
If any part of these Terms is found unenforceable, the remaining parts stay in effect.
